Right to Buy Extended

The much debated pilot of the Right to Buy extension for housing association tenants has begun following the government’s autumn spending review 2015, with tenants of five housing associations given the immediate chance to buy their homes.

The housing associations are as follows:

  • L&Q
  • Riverside
  • Saffron Housing
  • Sovereign
  • Thames Valley

This extension was a commitment in the Conservative party’s 2015 manifesto and means that from midnight on 25 November 2015, tenants of these Housing Associations ware able to start the process of buying their own home.

Only tenants that fulfil certain conditions will be able to exercise the right to buy in relation to the property in which they are currently residing. The right to buy applies to a secure tenant who has spent sufficient time as a public sector tenant (paragraph 6, Schedule 4 Housing Act (HA) 1985) and the qualifying period is currently three years for an applicant (section 119 HA 1985). There are exceptions to the rule including a list of excluded tenants and properties as well as restrictions on the right to buy in protected green and rural areas.
